Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records comprised in letter No.VP/EVA/K.43/322M/2009, dated 20.10.2009 on the file of the first respondent, quash the same and consequently direct the first and second respondent to provide water to the Survey No.310 of Kappalankarai Village and Post, Pollachi Taluk, Coimbatore District through the sluice No.7 from left gutter No.11 of the Kovilpalayam Sub-Channel under the Aaliyaar Irrigation Project.

It is represented by the learned counsel appearing for the petitioner that during the pendancy of this writ petition, the petitioner passed away and no legal representative of the petitioner came forward to represent the estate of the petitioner. The learned counsel further prayed this Court to grant liberty to the legal heirs of the petitioner to represent in future, if they so desire.

2.Recording the submission made by the learned counsel appearing for the petitioner, this writ petition is dismissed as abated. Liberty is granted to the legal heirs of the petitioner, if any, to represent in future, if they so desire. No costs. Consequently, connected miscellaneous petitions, if any, are closed.
