This civil miscellaneous petition has been filed to set aside the order of dismissal for non-prosecution dated 11.09.2023 and to restore S.A.No.1429 of 2010.

2. Having been satisfied with the reasons stated in the affidavit filed in support of this petition, this civil miscellaneous petition is ordered as prayed for.

3. Learned counsel for the petitioner is directed to verify whether the names of legal heirs are mentioned in the application filed by the appellant for restoring the second appeal is correct or not and the same should be reported on the next hearing date.

4. Post the matter on 21.01.2025.
