Prayer: Writ Petition is filed under Section 226 of the Constitution of India for issue of Writ of Mandamus, directing the respondent to consider petitioner's online application No.TN7201902011821 dated 01.02.2019 seeking legal heirs certificate that the petitioner i.e., Sampath Parthasarathy and his sister Padmini Bharath Iyengar are legal heirs of their deceased mother Vasantha Parthasarathy, on merits within the time time fixed by this Court.

O R D E R

This writ petition is filed is filed for the following relief: "To direct the respondent to consider petitioner's online application No.TN7201902011821 dated 01.02.2019 seeking legal heirs certificate that the petitioner and his sister, Padmini Bharath Iyengar are legal heirs of their deceased mother Vasantha Parthasarathy".

The petitioner submits that he is a permanent resident of Chennai and he and his sister, Padmini Bharath Iyengar are the two children of their parents i.e., Mr. P.S.Parthasarathy and Vasantha Parthasarathy. The petitioner submits that he was in Pharmaceutical Sales and Marketing job and considering the nature of his work, the petitioner was placed in different parts of India throughout his career and the petitioner's sister Padmini B. Iyengar, lives in Solapur Maharashtra ever since her marriage in the year 1974. 2/6

The petitioner would submit that in the month of July 1986, the petitioner got married and in the year 1987, he was transferred on promotion to Coimbatore by his company and during his tenure in Coimbatore, the petitioner has bought a piece of land in Coimbatore, under the sale deed dated 30.12.1987, which was registered jointly in the name of petitioner and his mother.

The petitioner would further submit that post the petitioner's retirement, his sister and the petitioner had planned to build a house on their land in Coimbatore and only then they realized a legal heirs certificate is required as he had purchased the property jointly in the name of the petitioner and his mother.

Therefore, the petitioner made an application for legal heir certificate through E-Seva Kendra in Vadapalani in Application No.TN7201902011821 dated 01.02.2019, with the respondent and he had followed up several times with the respondent but there was no progress on the legal heirship certificate application till today. 3/6

Therefore, the petitioner is before this Court.

6. Today, the learned Additional Advocate General produced a letter of the 1st respondent dated 13.02.2026, wherein it is stated that the petitioner's request has been rejected as early as on 07.02.2019. Therefore, he would submit that this writ petition cannot be entertained.

7. Heard the learned counsels on the either side and perused the records.

8. A perusal of the letter dated 13.02.2026 would show that the petitioner's request has been rejected as early as on 07.02.2019. In view of the above, this writ petition is disposed of with a liberty to the petitioner to challenge the rejection, in the manner known to law. No costs.
