O R D E R
The petition filed for a direction, directing the 2nd respondent to send the petitioner from Central Prison at Vellore to Christian Medical College and Hospital, Vellore for medical check up and cataract surgery.
2.The learned counsel appearing for the petitioner submitted that the petitioner is a convict prisoner at Central Prison, Vellore. Since the petitioner's vision Deteriorated day by day, due to cataract, he filed this petition, seeking direction to the 2nd respondent to send him from Central Prison, Vellore to Christian Medical College and Hospital, Vellore for medical check up and cataract surgery.
3.In this regard, the learned Public Prosecutor submitted that the petitioner was examined by the Assistant Surgeon, Central Prison Dispensary, Vellore and has filed a report of the same.
4.Heard Mr.M.S.Charles, learned counsel appearing for the petitioner and Mr.N.P.Kumar, learned Special Public Prosecutor. 5.The report of the Assistant Surgeon, Central Prison Dispensary, Vellore is as follows:
"This is to kindly report that Mr.Manivannan @ Ruben @ Subash, S/o.Mahalingam CT No:3441, who had been transferred from Central Prison, Cuddalore is a known case of Type II Diabetes, Hypertension, Intervertibral Disc Prolapse L4-L5 with Bilateral radiculopathy, left eye cataract is on regular medications since his admission to Central Prison, Vellore from 20.01.2019. He was initially evaluated by Ophthalmologist, while he was in Central Prison, Cuddalore and was advised to under cataract surgery with multifocal lens. Hence he was returned to Government Vellore Medical College Hospital for Ophthalmologist opinion. There he has examined on 19.02.2019 diagnosed to have (L) eye mature cataract. Blood investigations were taken & was asked to review on Saturday, 23.02.2019. Further he visited dental OP & had gross scaling done & was prescribed with medicines before returning to Central Prison, Vellore."
The above medical report dated 19.02.2019, reveals that the petitioner's left eye got mature cataract and it requires surgery.
6.Considering the facts and circumstances, the 2nd respondent is directed to permit the petitioner to undergo surgery at Christian Medical College and Hospital, Vellore, at the cost of the petitioner. It is also made clear that he shall be sent to the Christian Medical College and Hospital, Vellore with proper escorts. The 2nd respondent is directed to permit the petitioner to go to Christian Medical College and Hospital, Vellore for two days, for surgery and other reviews.
7.This Criminal Original Petition is disposed of in the above terms.
