Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of a Writ of Mandamus, directing the respondents herein to consider the representation of the petitioner dated 23.11.2023, for regularising in the post of Assistant Section Officer on the date when his Juniors were regularized in the line with the orders of the Hon'ble Court in WP.No. 6228 of 2021 dated 27.11.2023.

ORDER

This Writ Petition has been filed seeking to direct the respondents herein to consider the representation of the petitioner dated 23.11.2023, for regularising in the post of Assistant Section Officer on the date when his juniors were regularized in line with the orders passed by this Court in WP.No. 6228 of 2021 dated 27.11.2023.

2. Mr.T.M.Rajangam, learned Government Advocate takes notice on behalf of the respondents. In view of the consent expressed by the learned counsel on either side, the Writ Petition is taken up for final disposal at the stage of admission itself.

3. The case of the petitioner is that the petitioner was originally appointed as Office Assistant on 22.05.2000, and was promoted to the post of Assistant on 23.01.2007, and later he was temporarily promoted as Assistant Section Officer, by inclusion of his name in the Panel prepared for the year 2008-2009, dated 01.08.2008. The grievance of the petitioner is that though he has been working in the said post with effect from 25.02.2009, his name did not find place in the regular panel drawn vide G.O.Ms.No.31, dated 19.05.2014. Therefore, the petitioner, along with the co-workers made a representation dated 23.11.2023 before the first respondent, seeking regularization of the post of Assistant Section Officer. However, the same has not been considered till date. Therefore, the petitioner has preferred the present Writ Petition.

4. Learned Counsel appearing for the petitioner submits that it would suffice, if this Court issues a direction to the first respondent to consider the representation of the petitioner dated 23.11.2023 and pass appropriate orders on the same within the time that may be stipulated by this Court.

5. On the above contention, this Court heard the learned counsel appearing for the respondent.

6. In view of the limited relief sought for by the petitioner, this Court without expressing any opinion on the merits of the case, directs the first respondent to consider the petitioner's representation dated 23.11.2023 on merits and pass appropriate orders on the same in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and any other interested parties.

7. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
