The petitioners who were arrested and remanded to judicial custody on 05.12.2025, for the alleged offence punishable under Sections 103, 191(2), 191(3), 61(2) of BNS Act, in Crime No.388 of 2025 on the file of the respondent police, seeks bail.

The earlier criminal original petitions in Crl.O.P.Nos.35934 and 35929 of 2025 seeking bail has been dismissed by this Court by an order dated 08.01.2026 on the following reasons:

"6.Considering the submissions made by the learned counsel on both sides, the nature of the allegations, since the petitioners were arrested recently and that the investigation is still pending, this Court is not inclined to grant bail to the petitioners."

The earlier criminal original petition in Crl.O.P.No.834 of 2026 seeking bail has been dismissed by this Court by an order dated 12.01.2026 on the following reasons:

"6.Considering the submissions made by the learned counsel on both sides, the nature of the allegations, since the petitioner was arrested recently and that the investigation is still pending and that the petitioner is having two previous cases, this Court is not inclined to grant bail to the petitioner."

The learned counsel appearing for the petitioners submitted that there is no specific overt act attributed against these petitioners and are in judicial custody since 05.12.2025 and hence, seeks bail. Per contra, the learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that there are totally 11 accused in this case and the investigation has been concluded and the final report has been taken on file as PRC.No.5 of 2026.

Considering the facts and circumstances of this case, gravity of offence, the fact that there is no change in the circumstances and that the petitioners were only recently arrested and if the petitioners were granted bail, there is a likelihood of tampering of witnesses in this case, therefore, this Court is not inclined to revisit the earlier orders. 6.

Accordingly, these criminal original petitions stand dismissed. 06.02.2026 ssa 3/4
