Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus forbearing the respondents, their men, agents, people, subordinates or any others claiming through them from in any manner closing the Shop No.8708, now located at No.19, Alapakkam Main Road, Erikarai, Maduravoyal, Chennai- 600 095 and the bar attached to it unless under due process of law.

ORDER

Heard Mr.P.Singaram, learned counsel for the petitioner, Mr.P.Arumugarajan, learned standing counsel for respondent 1 to 3 and Mr.J.Pothiraj, learned Special Government Pleader appearing for the fourth respondent.

2.This writ petition has been filed praying for issuance of a writ of mandamus forbearing the respondents, their men, agents, people, subordinates or any others claiming through them from in any manner closing the Shop No.8708, now located at No.19, Alapakkam Main Road, Erikarai, Maduravoyal, Chennai- 600 095 and the bar attached to it unless under due process of law.

3. The learned Standing Counsel appearing for respondents 1 to 3 has filed a counter affidavit stating that as on today there is no proposal to either close or relocate the Shop No.8708. The affidavit filed by the first respondent is placed on record and the respondent is restrained to either close down or relocate the Shop No.8708.

The writ petition is disposed of with the above direction. No costs. Consequently, the connected miscellaneous petition is closed.
