Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the respondents herein to pass orders on the representation of the Petitioner dated 28.01.2019, thereby the respondents to grant permission for conducting cultural programme on 06.02.2019, night between 7.30 p.m. to 10.30 p.m. at Sri Mariyamman Kovil, Thalavaipatty Village, Salem West Taluk, Salem District-636302. Mr.E.Balamurugan, learned Special Government Pleader takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.
2. The petitioner seeks for Mandamus directing the respondents to pass orders on the representation dated 28.01.2019, wherein and whereby, he sought permission for conducting cultural programme on 06.02.2019 night between 7.30 p.m. to 10.30 p.m. at Sri Mariyamman Kovil, Thalavaipatty Village, Salem West Taluk, Salem District-636302.
3. The learned Special Government Pleader who takes notice for the respondents submitted that already a circular memorandum https://hcservices.ecourts.gov.in/hcservices/
dated 31.10.2018 has been issued by the Director General of Police to all the Station House Officers/Inspectors indicating the conditions to be imposed while considering the grant of permission to "Aadal Padal Programme". Therefore, he submitted that the petitioner's representation will be considered by the second respondent in the light of the Circular already issued by the Director General of Police dated 31.10.2018.
4. Recording the above said submission, this Writ Petition is disposed of, by directing the second respondent to consider the petitioner's representation dated 28.01.2019 and pass orders on the same on merits and in accordance with law by tomorrow (05.02.2019). No costs.
