Greams Road,Chennai-600 006 ... Respondents This case came up for settlement before the National Lok Adalat. Both the parties are present. Mr.Amar Dineshbhai Pandiya, learned counsel for the appellant and Mr.D.Bhaskaran, nd respondent/Insurance Company are learned counsel for 2 present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT The appellant has preferred this Civil Miscellaneous Appeal seeking to enhance the Award dated 24.09.2024 in M.C.O.P.No. 22 of 2018 passed by the learned Motor Accident Claims Tribunal(Special Sub Court No.II, Motor Accident Claim Petitions), Small Causes Court,Chennai.

2. The Tribunal has passed an award of Rs.1,42,500/- with interest at the rate of 7.5% per annum from the date of petition till the date of deposit along with cost.

3. The parties are present along with their respective counsels. The appellant has preferred the present Civil Miscellaneous Appeal for enhancement of award amount.

4. After great deliberation and discussion, both the parties have agreed for enhancement of award amount with further

additional sum of Rs.1,35,000/- (rupees one lakh thirty five thousand only) in full quit (inclusive of interest).

5. In view of the compromise arrived at between the parties, the National Lok Adalat hereby declare and decree that nd respondent/Insurance Company shall deposit the enhanced award amount of Rs.1,35,000/- (rupees one lakh thirty five thousand only) in full quit (inclusive of interest), within a period of six weeks from the date of receipt of a copy of this award. On such deposit, the appellant is permitted to withdraw the enhanced award amount immediately, without filing any formal petition, before the competent Court.

6. The Tribunal is directed to issue the cheques to the parties concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly.
