ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the 3 rd respondent to consider the representation made by the petitioner on 25.11.2024.

When the matter came up for hearing on 14.02.205, this Court passed the following order :- Mr.M.R.Gokul Krishnan, learned Additional Government Pleader, takes notice on behalf of respondents.

2. The only apprehension raised by the petitioner is that the subject property is an agricultural land and that some steps are

taken by the Tahsildar to re-classify the same as a residential zone. The petitioner has made a representation requesting not to make any such re-classification.

3. Learned Additional Government Pleader shall take instructions from the respondents and report before this Court. Post this writ petition under the caption 'for orders' on 07.03.2025.

The learned Additional Government Pleader appearing on behalf of respondents submitted that power and jurisdiction to reclassify the land is available only to the District Collector and not to the Tahsildar. Therefore, the petitioner can be directed to submit a representation before the 1 st respondent seeking for reclassification and the same will be considered on its own merits and in accordance with law.

In the light of the above submission and after considering the materials placed before this Court, there shall be a direction to the 1 st respondent to consider the representation made by the petitioner on 25.11.2024 on its own merits and in accordance with law and take a decision within a period of three months from the date of receipt of the copy of this order.

This writ petition is disposed of with the above directions. No costs.
