ORDER

This petition has been filed to direct the respondents 2 and 3 not to harass the petitioner or his parents.

The learned counsel for the petitioner has submitted that the marriage between the petitioner and the fourth respondent was solemnized on 04.09.2017 and thereafter she left the matrimonial home without any valid reason and hence the petitioner has filed HMOP.No.56 of 2019 on the file of the Sub Judge, Tiruthani for dissolution of marriage. He further submitted that to revenge the same, the fourth respondent wife lodged a false complaint before the third respondent and based on the same, the third respondent has issued summons to the

petitioner to appear within 5 days. In pursuance of the said summons, the petitioner appeared before the third respondent and also paid a sum of Rs.2,00,000/- to the account of the fourth respondent, but even thereafter, the second and third respondents are harassing the petitioner.

Per contra, the learned Additional Public Prosecutor has submitted that the second respondent has not received any complaint from the petitioner and on the contrary, the fourth respondent has lodged a complaint before the third respondent and on receipt of the said complaint, the third respondent has issued summons to the petitioner and that the second respondent has only assisted the third respondent to serve the summons and apart from that, the second respondent has not done anything.

4. If the petitioner feels that the third respondent has issued summons and harassing him, he has to challenge the said summons before the concerned court. Instead of that, he cannot contend that he is being harassed. Hence, this Court does not find any merit in this petition.

5. In the result, this Criminal Original Petition is dismissed.
