PRAYER : Petition filed Under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus,Calling for the records of the Communication issued by the 2nd respondent to the 3rd respondent bearing Ref. No. P17/2/R.101-987 /REV/20032004/5903 dated 21.10.2003 and quash the same and consequently direct the respondents 2 and 3 to refund a sum of Rs.50,968/- along with the interest at 12% per annum from 22-9-2003 till the date of repayment.

2. When the matter is taken up for hearing on 07.12.2018, again there is no representation on behalf of the writ petitioner and in order to give one more opportunity to the writ petitioner, it was directed to be listed under the same caption on 10.12.2018.

3. Today, when the matter is taken up for hearing, once again there is no representation on behalf of the writ petitioner. Thus, it is to be construed that the writ petitioner is not interested in pursuing the matter.

4. Accordingly, the writ petition stands dismissed for non- prosecution. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
