Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Madamus, calling for records and quash the impugned order of the second respondent No.E/PF/39-PMJ/2003-2004 dated 05.01.2005 and consequently direct the second respondent to reinstate the petitioner into service with full back wages and continuity of service and all other attendant benefits.

O R D E R

The order dated 05.01.2005 rejecting the claim of the writ petitioner for regularisation is under challenge in this writ petition.

2. The writ petitioner was appointed on 22.12.1981 as sweeper and he served for about 22 years on temporary basis. The writ petitioner was getting all facilities applicable to that of the permanent staff of the organisation including salary and allowance. The last drawn salary at the time of filing of the writ petition to the writ petitioner was Rs.5,500/- per month. https://hcservices.ecourts.gov.in/hcservices/

3. The grievances of the writ petitioner is that, in spite of the fact that he was continuing in services for more than 22 years and receiving the regular salary as applicable that of the permanent employee, his services were not regularised now.

4. The learned counsel for the respondent brought to the notice of this Court that the writ petitioner had received all the service benefits and allowed to retire from service on 30.11.2015 itself. In view of the fact that the respondents had settled the terminal benefits due to the writ petitioner in entirety and the writ petitioner also received the same and retired from service on 30.11.2015. Thus, no further adjudication needs to be entertained in respect of the grounds raised in the present writ petition.

4. Accordingly, the writ petition stands closed. However, there shall be no order as to costs.
