Prayer: Writ Petition under Article 226 of the Constitution of India praying for a writ of Mandamus to direct the respondents 1 to 3 to take action against the 4th respondent in the light of Government Order vide G.O.Ms.No.540, dated 04.12.2014 pursuant to the petitioner's representations dated 21.12.2020 and 29.12.2020. ORDER
(Made by the Hon'ble Acting Chief Justice) The petitioner seeks a direction to the respondents 1 to 3 to take action against the 4th respondent in the light of Government Order vide G.O.Ms.No.540, dated 04.12.2014 pursuant to his representations dated 21.12.2020 and 29.12.2020.
2. Learned counsel for the petitioner submitted that though the petitioner has made detailed representations to the second respondent on 21.12.2020 and to the respondents 1 and 3 on 29.12.2020 requesting them to remove the encroachment made by the fourth
respondent in S.Nos.21/1 and 23/1, which are classified as Roadside poramboke, the respondents 1 to 3 have not taken any action till date.
3. Learned State Government Pleader, taking notice for the respondents 1 to 3, seeks six weeks' time to consider the representations of the petitioner and to take action in accordance with law.
4. In view of the above, this writ petition is disposed of, directing the respondents 1 to 3 to consider the representations of the petitioner dated 21.12.2020 and 29.12.2020 and if there is any encroachment, as stated by the petitioner, the same shall be removed after issuing notice to the petitioner as well as the fourth respondent, in accordance with law, within six weeks from the date of receipt of a copy of this order.
