Respondents Prayer: This Writ Petition is filed under Article 226 of Constitution of India to issue a Writ of Mandamus, directing the 2nd respondent to consider and dispose of the petitioner's appeal dated 22.11.2018 in accordance with law, within the stipulated time as may be fixed by this Court.

O R D E R

The prayer in the Writ Petition is to direct the 2nd respondent to consider and dispose of the petitioner's appeal dated 22.11.2018 in accordance with law, within the stipulated time as may be fixed by this Court.

2. The learned counsel for the petitioner would submit that the petitioner's father was running cottage business and he has been paying the property and professional tax. After his demise, the business was taken over by the petitioner and hence he made an application to the 3rd respondent for name change in the property tax documents. The 3rd respondent rejected the application and returned the documents on 09.11.2018. The petitioner preferred an appeal to the 2nd respondent, challenging the aforesaid rejection order dated 09.11.2018. The said appeal is pending and no orders have been passed. Therefore, the present writ petition is filed before this Court.

3. Mr. B. Anand, learned Government Advocate takes notice for the respondents. With the consent of both the parties, the writ petition is disposed of, at the stage of admission itself.

4. Learned Government Advocate would submit that the 2nd respondent is the competent authority to dispose of the appeal and that if the said appeal is still pending, the same would be considered in accordance with law, within the time stipulated by this Court.

5. Considering the limited scope of prayer sought for by the petitioner, without expressing any opinion on the merits of the case, this Court is inclined to direct the 2nd respondent to consider the appeal of the petitioner dated 22.11.2018, on merits and in accordance with law and pass orders as expeditiously as possible, preferably within a period of twelve weeks from the date of receipt of a copy of this order.

6. The Writ Petition is disposed of, with the above direction. No order as to costs.
