Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents 1 and 2 to provide Electricity Service Connection to the petitioners' agricultural land of an extent of 2 acres 16 cents comprised in S.No.458/1B (Patta No.417) situated at Seemapuram Village, Ponneri Taluk, Tiruvallore District, in pursuance of the petitioners' application dated 2.5.2013.

ORDER

The present Writ Petition has been filed seeking to issue a Writ of Mandamus, directing the respondents 1 and 2 to provide Electricity Service Connection to the petitioners' agricultural land to an extent of 2 acres 16 cents comprised in S.No.458/1B (Patta No.417) situated at Seemapuram Village, Ponneri Taluk, Tiruvallore District, in pursuance of the petitioners' application dated 2.5.2013.

Learned Counsel appearing for the petitioners would submit that since objections raised by the erstwhile President of 145 Seemapuram Panchayat, Ponner Taluk, the respondents 1 and 2 have shown their reluctance to entertain the request of the petitioners for giving electricity service connection to their agricultural land. But this Court while admitting the present Writ Petition on 24.07.2013, also directed the respondents 1 and 2 to provide electricity service connection to the petitioners' agricultural land as per seniority and also as per Clause 27(2) of the Code on paying necessary charges by the petitioners in M.P.No.1/2013.

Now it is represented that by virtue of the order passed by this Court, the respondents 1 and 2 also have given electricity service connection to the petitioners agricultural land mentioned above as per seniority and also as per Clause 27.2 of the Tamil Nadu Electricity Distribution Code. Further, it appears that the 3rd respondent Objector is no longer continuing as President since his tenure of presidentship also came to an end long time ago. Therefore, as the objector 3rd respondent is no longer continuing as a President and by virtue of the order of this Court, the electricity service connection has been given to the petitioners agricultural land, this Court is of the view that the prayer of the writ petitioners has been granted to them.

In view of the above, the Writ Petition is ordered accordingly. No costs.
