Respondent Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned order dated 20.07.2011 in 1/G4/2577/Tha Aa Po Ka/10 of the respondent and quash the same consequently, to direct the respondent to refund the excess recovery amount recovered by the respondent and to pay with 12% interest to the petitioner.

ORDER

This Writ Petition has been filed for issuance of Writ of Certiorarified Mandamus to call for the records relating to the impugned order dated 20.07.2011 in 1/G4/2577/Tha Aa Po Ka/10 of the respondent and quash the same, consequently, to direct the respondent to refund the excess recovery amount recovered by the respondent and to pay with 12% interest to the petitioner.

2. The learned counsel appearing for the respondent submitted that the recovery order was withdrawn and whatever the amount withdrawn from the salary of the petitioner is refunded after deducting a sum of Rs.1,000/- as per Settlement under Section 12(3).

4. In view of the submission, nothing survives for further adjudication in this writ petition. Accordingly, this Writ Petition stands dismissed as infructuous.
