Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certorarified Mandamus calling for the records relating to the proceedings of the 3rd respondent dated 08.02.2022 bearing reference No.R.C No.A1/458/2021 and to quash the same as illicit, improper, incompetent, arbitrary and ultra vires and consequently, direct the respondents to reinstate the petitioner in service with all service and monetary benefits within a time frame as fixed by this Court.

O R D E R

This writ petition has been filed for issuance of a Writ of Certorarified Mandamus calling for the records relating to the proceedings of the 3rd respondent dated 08.02.2022 bearing reference No.R.C No.A1/458/2021 and to quash the same as illicit, improper, incompetent, arbitrary and ultra vires and consequently, direct the respondents to reinstate the petitioner in service with all service and monetary benefits within a time frame as fixed by this Court.

2.The learned Additional Government Pleader appearing for the respondents would submit that the suspension was based on the case registered against the petitioner for the offence under Section 70 of Prevention of Corruption (Amendment) Act 2018 and the petitioner has made a representation for revocation of suspension order and the same is now under the consideration of the respondents.

3. Recording the submission made by the learned Additional Government Pleader, without expressing any opinion on merits, it is open to the 3rd respondent to consider the representation of the petitioner on its own merits and pass appropriate orders, within a period of twelve weeks from the date of receipt of copy of this order.
