These Civil Miscellaneous Petitions have been filed (a) to condone the delay of 398 days in filing the petition to set aside the abatement caused due to the death of the first respondent in S.A.No.1064 of 2005, (b) to set aside the abatement caused due to the death of the first respondent in S.A.No.1064 of 2005 and (c) to permit the petitioners/Appellants to bring on record the legal representatives for the deceased first respondent as R4 to R8.

2. Learned counsel for the respondents has also not raised any serious objection for allowing these petitions.

3. This Court is also satisfied with the reasons stated in the affidavits filed in support of these petitions. Accordingly, CMP.Nos.3337, 3339 & 3341 of 2020 are allowed as prayed for.

4. Registry is directed to carry out the necessary amendment in the cause title and post the second appeal for hearing on 14.06.2021. 22.04.2021 nl ABDUL QUDDHOSE, J.
