ORDER

The writ petition has been filed for direction to direct the respondent 1 & 2 to appoint the petitioner in the post of cook based on her employment seniority and also based on the interview letter issued by the second respondent in proceeding Na.Ka.J3/17513/09 dated 19.01.2010 with all attendant benefits.

The petitioner was initially sponsored under the Most Backward Class category and the second respondent sent a call letter for interview and certificate verification for the post of Cook. However, the said selection process was not completed since, in the notification SC/ST candidates were missed. Again the list of eligible candidates were called for from the employment exchange. However, in revised list the petitioner was not sponsored by the employment exchange to the post of Cook. Therefore, the petitioner filed this present writ petition with the above said prayer.

Heard the learned counsel appearing on either side and perused the material placed before this Court. 4.

On perusal of counter affidavit filed by the third respondent revealed that maximum age limit for the post of cook is fixed as 40 years. However, now the petitioner is aged about 52 years. Therefore, she crossed the maximum age limit and she cannot be appointed to any post. Hence, the prayer sought for in this writ petition cannot be granted and it is liable to be dismissed.

Accordingly, the Writ Petition stands dismissed.

Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
