Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Habeas Corpus, directing the 1st and 2nd respondent to produce the petitioner's daughter namely S.Jeeva Sri, D/o.Sivaprakasam, aged about 1 1/2 years before this Court from the custody of the 3rd respondent and hand over her custody to the petitioner forthwith.

ORDER

AND N.SENTHILKUMAR , J.

With the consent of both the parties, the matter was referred to the Mediation before the Tamilnadu Mediation and Conciliation Centre, High Court, Madras. By a Settlement Agreement dated 05.02.2025, both parties have mutually resolved the dispute among themselves and have recorded the settlement in the following manner:

"....

6.The following settlement has been arrived at between the parties hereto:- a. Sivaprakasam is ready to handover 5 sovereigns of gold jewels of his wife to Rajalakshmi within 2 months. Further, ready to handover household articles to Rajalakshmi on 08.02.2025. b. The minor female child Jeeva Sri may be in the custody of Rajalakshmi in every month of first weekend Saturday and Sunday.

c.If Sivaprakasam going to get marry again, the custody of the child may be transferred to Rajalakshmi.

d.If the above conditions violated by either parties, the settlement stands cancelled automatically."

However, in view of the mutual agreement, no further orders are required in the present Habeas Corpus Petition.
