Prayer: Writ Petition filed under Article 226 of Constitution of India, 1/4
praying to issue a Writ of Declaration or any other appropriate Writ, Order or direction declaring the letters of the 3rd respondent to the petitioners holding them not eligible to join the pension Scheme as illegal, arbitrary, discriminatory and violative of Articles 14, 16 and 309 of the Constitution of India, (b) declaring that the petitioners are eligible for another option to join the Pension Scheme of the 3rd respondent under Clause (E)(3)(a) of the said Joint Note dated 27.4.2010 for Officer employees and Clause (II)(a) of the Terms of Settlement of the said Memorandum of Settlement dated 27.4.2010 for workmen employees and (c) directing the 3rd respondent to issue to the petitioners forthwith the Letters of Offer extending another option to join the Pension Scheme under (E)(3)(b) of the said Joint Note dated 27.04.2010 in respect of Officer employees, and clause (II)(b) of the Terms of Settlement of the said Memorandum of Settlement dated 27.04.2010 in respect of workmen employees.

Today, when the matter is taken up for hearing, Mr. S. Apunu, learned counsel, who is representing Mr. K.M. Ramesh, learned counsel on record for the petitioners, submitted that the relief sought for in the present writ petition has become infructuous and he also made an endorsement to that effect.

counsel appearing for the petitioners, this Writ Petition is dismissed as infructuous.
