Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the Learned Judicial Magistrate No.V, Gopalapuram, Coimbatore 641 018, to implement the direction passed by this Hon'ble Court by order dated 07.03.2014 passed in Crl.R.C.No.614 of 2007 by hearing the Crl.M.P.No.1518 of 2016 in C.C.No.303 of 2003 pending before the Learned Judicial Magistrate No.V, Goapalapuram, Coimbatore 641 018, expeditiously to conduct on a day to day basis within a stipulated time. ORDER

This petition has been filed to direct the Learned Judicial Magistrate No.V, Gopalapuram, Coimbatore 641 018, to implement the direction passed by this Hon'ble Court by order dated 07.03.2014 passed in Crl.R.C.No.614 of 2007 by hearing the Crl.M.P.No.1518 of 2016 in C.C.No.303 of 2003 pending before the Learned Judicial Magistrate No.V, Gopalapuram, Coimbatore 641 018, expeditiously to conduct on a day to day basis within a stipulated time.

2. It is seen that the case in C.C.No.303 of 2003 has been taken cognizance of for the offences under Section 195 read with 340 Cr.P.c. and Sections 191, 192, 193, 211 and 464 I.P.C. as against respondents 1 to 3 and it is pending from the year 2003 onwards. In spite of direction issued by this Court by an order dated 07.03.2014 thereby directing the learned Judicial Magistrate No.V, Gopalapuram, Coimbatore to conduct trial on day to day basis and complete the trial within a period of three https://hcservices.ecourts.gov.in/hcservices/

months, the trial court did not complete the trial.

3. Considering the facts and circumstances of the case, the learned Judicial Magistrate No.V, Gopalapuram, Coimbatore is directed to complete the trial in C.C.No.303 of 2003 within a period of two months from the date of receipt of a copy of this Order.

4. With the above direction, this Criminal Original Petition is disposed. Consequently, connected miscellaneous petition is closed.
