Decree: This second Appeal Coming on for hearing on this day upon perusing the Grounds of Appeal, the Judgment and Decrees of The Lower Appellant Court and the Court of First instance and the material papers in the suit and upon hearing the arguments of Mrs.A.L.Ganthimathi, Advocate for the Appellant, and of Mr.V. Manohar, Advocate for the Respondents 1 and 3 and this Court while allowing the Second Appeal, doth order and decree as follows:-
1. that the Judgment and Decree of the learned Sub Judge, Thirupattur in A.S.No.4 of 2011 dated 25.04.2012 be and hereby is set aside and the Judgment and Decree dated 29.09.2010 in O.S.N.327 of 2004 on the file of the learned District Munsif, Thirupattur is restored.
2. that there be no costs in this Second Appeal. *Copy of the Schedule of property enclosed.
