Respondents Prayer : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the respondents to issue community certificates to the list of persons belonging to Bandi and Godda community attached along with the representation dated 25.8.2022.

ORDER

(Order of the court was made by the Hon'ble Chief Justice) We have heard Ms.A.Rajini, learned counsel for the petitioner; and, Mr.A.Edwin Prabakar, learned State Government Pleader, assisted by Mr.T.K.Saravanan, learned Government Advocate for the respondents.

2. Learned counsel for the petitioner submits that directions be given to issue community certificates to the list of persons belonging to Bandi and Godda community attached with the representation of the petitioner dated 25.8.2022.

3. Such a public interest litigation cannot be entertained. The community certificate has to be granted on individual application and on the satisfaction of the authority, based on necessary documents,

that the person belongs to the said community. The present public interest litigation, as such, is misplaced.

4. If the individual files an application before the authority for grant of the community certificate, then the authority shall consider the said application on its own merits and in accordance with law and then take a decision.

5. With these observations, the writ petition is disposed of. There shall be no order as to costs.
