This Court by order dated 17.03.2023 in Crl.A.No.103 of 2015, confirmed the conviction for the offence under Section 498A of IPC and set aside the conviction for the offence under Section 306 of IPC. In respect of Section 498A, the learned brother Hon'ble Mr.Justice N.Anand Venkatesh, on taking into consideration that the two daughters are studying in college, modified the sentence to one of payment of Rs.4,00,000/- as compensation, as follows:
"The appellant is further sentenced to pay a compensation of a total sum of Rs. 4,00,000/-. The appellant shall take a fixed deposit in the name of his two daughters and deposit a sum of Rs. 2,00,000/- for each of the daughter and the fixed deposit shall be for a period of 5 years. This deposit shall be made on or before 14.04.2023 at Indian Bank, High Court Branch, Chennai and the original fixed deposit receipts shall be produced before this Court. If the appellant defaults in the payment of compensation amount, he shall undergo six months simple imprisonment."
2.Today, the matter is posted for reporting compliance and it appears that the Appellant has not complied with the earlier order dated 17.03.2023, 1/3
passed by this Court. In view of the default clause, he shall undergo six months simple imprisonment. Registry is directed issue non bailable arrest warrant to be executed by the Respondent police to secure and to produce before the learned Sessions Judge, (Mahila Judge), Chennai, to remand the Accused to undergo remaining period of imprisonment. 19.04.2023 sai Note: Issue order copy today (19.04.2023) 2/3
