This writ petition has been filed for the issue of writ of Mandamus directing the 1st respondent to dispose of the revision filed by the petitioner on 09.12.202 and to pass final orders within the time frame fixed by this Court. 2.
Heard Mr.K.Govi Ganesan, learned counsel for the petitioner and Mr.P.SAthish, learned Additional Government Pleader for respondents 1 to 3. 3.
The case of the petitioner is that his right was determined by a competent Civil court in OS No.38 of 2019 through a judgement and decree dated 28.04.2023 on the file of the District Munsif Cum Judicial Magistrate, Veppanthattai. Thereafter, the petitioner made an application before the 3rd respondent and the 3rd respondent through proceedings dated 07.02.2024 issued patta in favour of the petitioner. Aggrieved by the same, the private respondents filed an appeal before the 2nd respondent. The 2nd respondent through 2/4
proceedings dated 23.09.2024 reversed the order passed by the Tahsildar. Aggrieved by the same, the revision has been filed before the 1st respondent on 09.12.2024. Since the same was not taken up and final orders were passed, the present writ petition has been filed before this Court. 4.
Taking into consideration the facts and circumstances of the case and considering the limited relief sought for in this writ petition, there shall be a direction to the 1st respondent to deal with the revision petition filed by the petitioner on 09.12.2024 after affording an opportunity to the respondents 4 and 5 and final orders shall be passed on its own merits and in accordance with law, within a period of eight weeks from the date of receipt of the copy of this order. 5.
This writ petition is disposed of with the above directions. No costs.
