O R D E R

Today, when the matter is taken for hearing, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw the present Original Petition with a liberty to file a suit before the Civil Court. He has also made an endorsement to that effect in the bundle, which is extracted as follows:- "Petitioner may be permitted to withdraw the application with a liberty to file claim before the Civil Court."

2. Recording the submissions and the endorsement made by the learned counsel appearing for the petitioner, this Original Petition is dismissed as withdrawn with liberty to the petitioner to file a suit before the Civil Court within a period of three (3) months from the date of receipt of a copy of this order. There shall be no order as to costs.
