(CRIME NO.159/2021) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to Modify the condition imposed in Para No.7 i n Crl.OP.2078/2022 by order dated 02.02.2022 i/e directing the petitioner herein to deposit a Sum of Rs.50,00,000/-(Rupees fifty lakhs only) totaling to the Credit of the above case in Crime No.159/2021 to the effect that the petitioner may be permitted to deposit a sum of Rs.20,00,000/- has to be deposited immediately, Rs. 5,00,000/- to be deposited within a period of one week and the remaining sum of Rs.25,00,000/- to be deposited within a period of three months and pass such further or other orders.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S A.MURUGAVEL, Advocate for the petitioner and of MR.L.BASKARAN,Govt. Advocate(Crl. Side)on behalf of the Respondent the court made the following order:- The present petition has been filed to modify the condition imposed on the petitioner in Para 7 (c ) of the order dated 02.02.2022 passed by this Court in Crl.O.P.No.2078 of 2022 while granting bail.
2. The learned counsel for the petitioner prays to modify the condition imposed in Crl.O.P.No.2078 of 2022 dated 02.02.2022 by this Court.
3. The learned Government Advocate (Crl. Side) as well as the intervenor raised objection stating during the Covid period, the petitioner came out from Jail, but, he has not complied with the order of this Court with regard to a deposit of sum of Rs.50,00,000/- and he should appear before the respondent.
4. Considering the above facts, it is clear that the petitioner has not complied with the order as imposed by this Court and also more than two crores of amount has been involved in this Case. Hence, this Court is not inclined to modify the condition.
5. Accordingly, this Criminal Miscellaneous Petition is dismissed. However, this Court shall extend a further period of two weeks to the petitioner to comply with the order from the date of receipt of a copy of this order.
