O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) r/w 20(b)(ii)(B) and 25 of the NDPS Act, 1985 in Crime No.58 of 2024 on the file of the respondent Police, seeks anticipatory bail. This is the second anticipatory bail application of the petitioner herein and this Court, vide order dated 01.09.2025 in Crl.M.P.No.16253 of 2025 had cancelled the anticipatory bail earlier granted to the petitioner by this Court, vide order dated 01.04.2024 in Crl.O.P.No.8071 of 2024 for the following reasons: "2.

This Court passed an order dated 01.04.2024 and the conditions imposed therein has not been complied with. Now the petitioner for modification is filed after lapse of one year and four months. This Court finds no genuineness in this application. Hence, this Criminal Miscellaneous Petition stands dismissed. Further, the Anticipatory bail granted stands cancelled for non-compliance of the condition imposed in Crl.O.P.No.8071 of 2024 dated 01.04.2024."

Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent. 3.

The fact that the petitioner had not utilised the earlier anticipatory bail granted to him by this Court in Crl.O.P.No.8071 of 2024 2/4

by not complying with any of the conditions imposed on him; that since the petitioner had not come forward to comply any of the anticipatory bail conditions imposed on him, the modification petition filed by the petitioner in Crl.M.P.No.16253 of 2025 was dismissed by this Court, vide order dated 01.09.2025 and also cancelled the anticipatory bail earlier granted by this Court in Crl.O.P.No.8071 of 2024.

In the said circumstances, the petitioner had approached this Court once again seeking for anticipatory bail. In view of the earlier proceedings taken place before this Court, this Court is not inclined to consider the anticipatory bail application of the petitioner herein. 5.

Accordingly, this criminal original petition stands dismissed. 05.02.2026 stn 3/4
