2 S.V.RAJA Under section 115 code of CPC filed against the fair order and decretal order of the leaned I Additional Subordinate Judge of Cuddalore allowing E.P.NO.53 OF 2010 IN A.R.NO.6 OF 2007 DATED 29.01.2011 in CRP.NPD.NO.1806 OF 2011.

Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.D.BASKAR, Advocate for the petitioner and Respondent not appearing either in person or by an advocate the court made the following order:- Learned counsel for the petitioner has raised the sole point agitated that the loan amount is said to have been due on hypothication agreement, which has been duly discharged and relied upon the Registration certificate issued by the RTO and hence, he contended that the award passed in A.No.6 of 2007 by the Arbitrator in the arbitrator proceedings is null and void and as against the execution petition, he want to attach the movable properties listed in the list of movable properties announced in the execution proceedings, which does not belonging to the petitioner. 2.Heard the learned counsel for the petitioner in part and the learned counsel appearing for the respondent is absent. https://hcservices.ecourts.gov.in/hcservices/
