ORDER
This Writ Petition has been filed by the petitioner seeking for a Writ of Certiorari, to call for the Award passed in I.D.Nos.318/2003 to 323/2003, 325/2003, 326/2003, 340/2003 and 341/2003 on the file of first respondent dated 30.09.2008 and to quash the same.
2. The case of the petitioner is that, the respondents 2 to 11 have raised industrial disputes in I.D.Nos.318/2003 to 323/2003, 325/2003, 326/2003, 340/2003 and 341/2003 on the file of the 1st respondent seeking reinstatement with back wages. After adjudication, the 1st respondent passed award ordering reinstatement with continuity of service, however, denied back wages. Challenging the same, the petitioner-management has filed the present writ petition.
3. When the matter is taken up for hearing today, learned counsel appearing for the petitioner, on instructions, submitted that, during the pendency of this writ petition, respondents 2, 7 to 10 were reinstated in Page No.2 of 4
service and they have resigned on 11.10.2010, pursuant to which, gratuity amount and other terminal benefits were settled on 11.02.2019, 11.11.2013, 23.12.2013, 04.02.2019 and 11.11.2013 respectively. In respect of the respondents 3 to 5 and 11, they were retired from service on 04.08.2010 and after their retirement, the entire terminal benefits were given to them. However, in respect of the 6th respondent, learned counsel, reported no instructions.
4. In view of the subsequent developments that some of the employees have resigned their service and other employees were retired from service and the entire benefits have been settled in their favour, this court is of the view that nothing survives for adjudication in this writ petition.
5. Accordingly, this Writ Petition is dismissed as infructuous. No costs.
