ORDER

This Criminal Miscellaneous Petition has been filed to condone delay of 232 days in preferring the Criminal Appeal challenging the Judgement dated 13.12.2023 passed in Spl.S.C.No.59 of 2023 by the Learned Sessions Judge, Special Court for Trial of cases under SC/ST(POA) Act, Coimbatore.

2. Mrs.G.V.Kasthuri, learned Additional Public Prosecutor, takes notice for the respondents 1 and 2.

3. Despite service of notice on the third respondent and name being printed in the cause list, none appeared on behalf of the third respondent.

4. Though the reasons stated in the accompanying affidavit is not satisfied, in order to give an opportunity to the petitioner, delay is condoned on condition that the petitioner shall pay a sum of Rs.10,000/- [Rupees Ten Thousand only] to the victim/the third respondent herein on or before 22.04.2025, failing which, this criminal miscellaneous petition shall stand dismissed automatically without any further reference to this Court.
