The petitioners, who apprehends arrest for the alleged offences punishable under Section 302 of I.P.C in Crime No.70 of 2023, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the one girl by name Ragavi is relative of the petitioners. The said Ragavi is a married girl and she had illegal intimacy with the deceased and refused to live with her husband, due to which the petitioner along with other accused brutally attacked the deceased and murdered him. Hence the complaint. 3.The learned counsel for the petitioners would submit that the petitioners was only present at the scene of occurrence, that apart he has not committed any crime as alleged by the prosecution. Hence prays for grant of anticipatory bail to the petitioners.

4.The learned Government Advocate (Crl.Side) would submit that the petitioners along with other accused brutally attacked the deceased and murdered him. Hence he vehemently opposed for grant of anticipatory bail to the petitioners.

5. Considering the facts and circumstances of the case and the heinous nature of offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioners.

6. Accordingly, the Criminal Original Petition is dismissed. 08.02.2023 smn
