This Criminal Original Petition has been filed to quash the proceedings in C.C.No.1056 of 2010 pending on the file of the learned Judicial Magistrate No.II, Coimbatore.
2. Today, the first petitioner along with his counsel on record and the second respondent / defacto complainant are present. Their identities have been verified. They have submitted that during the pendency of the proceedings in C.C.No.1056 of 2010 before the learned Judicial Magistrate No.II, Coimbatore, the dispute between them has been amicably settled and a memorandum of understanding dated 18.02.2017 has been entered into, as per which, the first petitioner has handed over a Demand Draft for a sum of Rs.45 lakhs to the second respondent / defacto complainant. When this Court enquired the parties, particularly, the second respondent / defacto https://hcservices.ecourts.gov.in/hcservices/
complainant about the factum of compromise and payment of Rs.45 lakhs towards full and final settlement, she admitted the same. She also expressed no objection in quashing the criminal proceedings pending against the petitioners herein. The Memorandum of Understanding and receipt for Rs.45 lakhs have been enclosed in the typed set of papers filed along with this petition to that effect.
3. In view of the above, this Criminal Original Petition is allowed and the criminal proceedings in C.C.No.1056 of 2010 on the file of the learned Judicial Magistrate No.II, Coimbatore pending against the petitioners herein is quashed. The Memorandum of Understanding dated 18.02.2017 and receipt for payment of Rs.45 lakhs between the parties, filed along with this petition, are taken on record.
