Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to consider the petitioners for the post of Sanitary workers with the 4th respondent Municipality based on their representation dated 01.06.2015 forthwith.
For Petitioners:
Mr.C.Prabakaran For Respondent :
Mr.I.Sathish Additional Government Pleader for R1 to R3 Mr.P.Srinivas, for R4
O R D E R
The petitioners seek for a mandamus directing the respondents to consider them for the post of Sanitary Workers in the fourth respondent Municipality, based on their representation dated 01.06.2015.
2. It is seen that the petitioners are working as Sanitary workers for the past 10 years on contract basis in the fourth respondent Municipality. On 01.06.2015, the petitioners made a representation to the respondents seeking regularization of their service as Sanitary workers on consolidated basis. The grievance of the petitioners before this Court is that even though the said representation was made on 01.06.2015, the same has not been considered by the respondents so far. Hence, the petitioners are before this Court with the relief as stated supra.
3. Heard both sides.
4. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioners, as it is for the respondents to consider and decide the same and pass appropriate orders on merits and in accordance with law. Accordingly, this writ petition is disposed of, only by directing the respondents to consider the representation of the petitioners dated 01.06.2015 and pass orders on the same on merits and in accordance with law, after hearing the petitioners. Such
exercise shall be done by the respondents within a period of eight weeks from the date of receipt of a copy of this order. No costs.
