Prayer: Writ petition filed under Article 226 of the Constitution of India seeking to issue a Certiorarified Mandamus, calling for th records pertaining to the impugned reply of the 2nd respondent passed in Ref.No.O.Mu.Aa.6/15758/2013, dated 26.04.2013 and quash the same and consequently directing the 2nd respondent to take necessary disciplinary proceedings for facing FIR with grave charges. ORDER
This writ petition has been filed challenging the order passed by the 2nd respondent thereby directing the petitioner to lodge complaint before the concerned jurisdictional Police Station.
2. The petitioner's husband was working in the Tamil Nadu Electricity Board. There was family dispute between the petitioner and her husband. Therefore, she lodged a complaint stating that her husband is facing trial for the offence under Section 498(A) and 506(ii) of IPC and Section 4 of Dowry Prohibition Act, in C.C.No.58 of 2011 on the file of the Judicial Magistrate, Ponneri. Once again, the petitioner lodged complaint before the 2nd respondent alleging that her husband is having illegal intimacy with other woman and also he has already retired from service and as such seeks appropriate action against him.
3. On perusal of the complaint lodged by the petitioner revealed that there are allegations as against her husband for his activities. Therefore, the 2nd
respondent rightly directed the petitioner to lodge complaint before the concerned jurisdictional Police Station. Hence, this Court finds no infirmity or illegality in the orders passed by the 2nd respondent and this writ petition is devoid of merits.
4. Accordingly, this writ petition stands dismissed. There shall be no order as to costs.
