C.M.P.No.6016 of 2024 C.M.P.No.6016 of 2024 in W.A.SR.No.14007 of 2024 M.S.RAMESH, J., and M.JOTHIRAMAN, J., (Order of this Court was delivered by M.S.RAMESH.J.,) The reason assigned for condoning the inordinate delay of 531 days in challenging an interim order, whereby interim stay was granted on the condition that the Management deposits 25% of the amount computed by the authorities, is that since there was a change in the Management, they could not take appropriate follow up action and the other reason is that the employee had assured the Management that he would not insist for substance allowance and therefore, the Management had not challenged the interim order.
2. We fail to understand as to how the Management can take an employee's alleged assurance that he will not enforce his legal rights and remain silent, more particularly when the interim order of this Court directed the Management to deposit 25% of the amount computed by the authorities. The other reason, that there was a change in Management, is bereft of any particulars as to when such a change commenced, which deprived them from a follow up action. C.M.P.No.6016 of 2024 and M.JOTHIRAMAN, J., are not satisfied with either of the reasons assigned in the affidavit filed in support of the petition.
