(Delivered by M.M.SUNDRESH,J) Instant Contempt Petition has been filed to punish the respondent for willful disobedience of the order dated 2/11/2017 made in W.P.No.5497 of 2017.

2. Heard Mr.R.Malaichamy, learned counsel for the petitioner and Mr.A.N.Thambidurai, learned counsel for the respondent.

3. Today, when the matter is taken up for hearing through Video Conferencing, learned counsel appearing for the respondent would submit that along with the case of the petitioner, other cases have been considered by the Committee and found that the case of the petitioner is not feasible for compassionate appointment.

4. Since a decision has been taken, remedy is open to the petitioner is to challenge the same. However, a decision has not been communicated to the petitioner. Even assuming the said order is not in exact compliance of what order passed by this Court, we cannot haul them for contempt.

5. In such a view of the matter, instant Contempt Petition is closed. The respondent is directed to communicate the decision to the petitioner, within a period of three weeks, from the date of receipt of a copy of this order. Liberty is given to the petitioner to challenge it in the manner known to law. We make it clear that it is open to the petitioner to 2/4

raise all the contentions including the non-compliance of the order passed by this Court.
