CRIME NO.1171 OF 2021.

Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify condition imposed in clause No.6(a) Crl.OP.No.25768 of 2021 vide order dated 03.01.2022 with regard to clause No.6(a) that the petitioners are directed to deposit a sum of Rs.10,000/- (Rupees Ten thousand only) as interim maintenance until modified by the court of law to the credit of the daughter's account within first week of every English Calendar month and shall produce the said receipt before the court below.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.K.MYILSAMY, Advocate for the petitioner and of M/S.L.BASKARAN, Government Advocate (Crl.Side) on behalf of the Respondent the court made the following order:- The Petitioners have filed this petition seeking to modify the condition that the petitioners were directed to deposit a sum of Rs.10,000/- (Rupees Ten Thousand only) as interim maintenance until modified by the Court of Law to the credit of the daughter's account within first week of every English Calender month and shall produce the said receipt before the Court below, imposed by this Court in Crl.O.P.No.25768 of 2021 dated 03.01.2022..

2. The learned Counsel appearing for the petitioners submitted that the first petitioner was relieved from company even before the order of this Court. To that effect reliving order was issued by his company on 08.05.2021. At present he is a jobless person, Even for meeting out his daily routine expenses, he is struggling a lot and borrowing money from his friends. He further submitted that the first petitioner is not able to mobilize the funds. Hence, the present modification petition has been filed..

3. Heard the learned Government Advocate (Crl.Side) appearing for the respondent police.

4.Considering the facts and circumstances of the case, reason is justifiable, the condition already imposed by this Court is modified and the first petitioner is directed to deposit a sum of Rs.7,000/- (Rupees Seven Thousand only) as interim maintenance until modified by the Court of Law to the credit of the daughter's account within first week of every English Calender month and further two weeks time is granted to the petitioners to comply with the conditions imposed by this Court. This petition is ordered.
