Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the respondents 1, 2 and 4 to take suitable action against the 5th respondent within stipulated time for his illegal quarrying in S.No.226/1 situated at Kondappanaiyakan Patti Village, Senthamangalam Taluk, Namakkal District on the basis of the petitioner's representation dated 06.10.2023.

ORDER

(Made by the Hon'ble Chief Justice) Heard Ms.G.R.Sreemagal, learned counsel for the petitioner and Mr.A.Edwin Prabakar, learned State Government Pleader assisted by Mr.T.K.Saravanan, learned Government Advocate for respondents 1 to 4.

2. The petitioner avers encroachment by the fifth respondent in S.No.226/1 situated at Kondappanaiyakan Patti Village, Senthamangalam Taluk, Namakkal District.

3. It is submitted by learned counsel for the petitioner that the fifth respondent is illegally carrying out quarrying activities in the said survey number.

4. Learned Government Advocate, on instructions, submits that mining license is issued in favour of the fifth respondent on 01.09.2021 and the same is valid up to 31.08.2026.

5. The petitioner has filed a representation before the fourth respondent/Tahsildar. The Tahsildar may decide the representation filed by the petitioner on its own merits and in accordance with law.

6. In light of that, the writ petition stands disposed of. There shall be no order as to costs.
