Respondent Prayer: The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the respondent to consider and pass orders on the representation dated 3.1.2018, followed by the reminder dated 8.2.2018, made by the petitioner for renewal of permit covering the route from Hosur to Dharmapuri, in terms of the provisions of Section 6(1) of the Act 41 of 1992.

O R D E R

Mr.E.Balamurugan, learned Special Government Pleader takes notice for the respondent. By consent of the parties, this writ petition is taken up for final disposal at the admission stage itself.

2. The prayer sought for in this writ petition is for a issuance of writ of mandamus, directing the respondent to consider and pass orders on the representation dated 3.1.2018, followed by the reminder dated 8.2.2018, made by the petitioner for renewal of permit covering the route from Hosur to Dharmapuri, in terms of the provisions of Section 6(1) of the Act 41 of 1992.

3. The case of the petitioner is that he is a stage carriage operator operating on the route from Hosur to Dharmapuri (Via) Shoolagiri, Krishnagiri, Kaveripattinam and https://hcservices.ecourts.gov.in/hcservices/

Kariamangalam, in respect of vehicle No.TN-D3785.

4. The learned counsel for the petitioner would submit that the representation of the petitioner for grant of replacement permit dated 03.01.2018 and reminder dated 08.02.2018 were not considered by the respondent, hence the present writ petition.

5. The learned counsel for the petitioner would further submit that it is suffice, if a direction is issued to the respondent to pass appropriate orders on the representation of the petitioner dated 03.01.2018.

6. The learned Special Government Pleader appearing for the respondent would submit that the representation of the petitioner dated 03.01.2018, will be considered on merits and in accordance with law.

7. In the light of the above submissions made by the learned counsels on either side, this Court, directs the respondent to pass appropriate orders on the representation of the petitioner dated 03.01.2018 on merits and in accordance with law, after providing due opportunity to all necessary parties, within a period of twelve weeks from the date of receipt of a copy of this order.
