ORDER

The petitioner, who was arrested and remanded to judicial custody on 11.01.2026 for the alleged offence punishable under Section 24(1) of Cigarette and Other Tobacco Products Act 2003 and 123 of BNS, 2023 in Crime No.11 of 2026, registered on the file of the respondent police, seeks bail. 1/4

2. The allegation against the petitioner is that the petitioner was involved in possession and sale of 40 kilograms of banned Tobacco Products in his petty shop. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there are three previous cases pending against him and that the contraband was seized from the petitioner's petty shop. Hence, he opposed for grant of bail to the petitioner.

5. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl.side) and perused the materials available on record.

6. Considering the nature of the allegations, the fact that the petitioner has three previous cases, pending against him, that the petitioner was arrested very recently, and that 40 kilograms of tobacco products were seized from his petty shop, this Court is not inclined to grant bail to the petitioner. 2/4
