ORDER

The petitioner, who was arrested and remanded to judicial custody on 30.10.2025 for the offences punishable under Sections 65(2) of BNS Act and Sections 5(l), 5(n), 5(m), 9(m), 6(1) of POCSO Act, in Crime No.58 of 2025, registered on the file of the respondent police, seeks bail. 1/4

2. This Court has twice dismissed the bail petition of the petitioner for the following reasons:

Earlier this court has dismissed the bail petition of the petitioner on 19.12.2025 on the ground of the age of the victim girl and that the petitioner has also committed aggravated penetrative sexual assault and investigation is still pending in this case.

3. The learned counsel appearing for the petitioner submitted that now the investigation is completed and final report is also filed. He further submitted that the petitioner is in judicial custody since 30.10.2025; and that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and sought for bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and submitted that the case is pending in Spl.S.C.No.58 of 2026 on the file of the POCSO Court, Tiruvannamalai and it is a case of aggravated penetrative sexual assault on the victim girl. Hence, he opposed for grant of bail to the petitioner.

5. I have gone through the statement recorded from the victim girl which reveals that the petitioner has not only committed aggravated sexual assault on the victim girl and also caused severe injuries to the victim girl. 2/4

6. Considering the fact that this is not only the case of penetrative assault and as recorded in the statement recorded from the victim girl, the petitioner has caused severe injuries to the victim girl, if the petitioner is granted bail, there is likelihood of tampering of witnesses, hence, this court is not inclined to grant bail to the petitioner.
