O R D E R

This Criminal Original Petition has been filed seeking a direction to the learned Judicial Magistrate, Fast Track Court (NI Act), Puducherry, to expedite the trial in S.T.C.No.2542 of 2020.

The submissions of the learned counsel appearing for the petitioner are as follows:- 2.1. The petitioner filed a complaint against the respondent/accused in S.T.C.No.2542 of 2020 for the offence under Section 138 of the Negotiable Instruments Act, before the learned Judicial Magistrate, Fast Track Court (NI Act), Puducherry. 2.2. Since the respondent/accused delayed the trial, the petitioner approached this Court in Crl.O.P.No.2403 of 2024 seeking a direction to expedite the trial. This Court, vide order dated 06.02.2024, directed the learned Magistrate to complete the trial within a period of three months from the date of receipt of a copy of the said order. 2.3. However, despite the said order of this Court, there has been no progress in the trial and the respondent/accused is delaying the proceedings. The respondent has not taken steps to cross-examine the complainant, who has already been examined in chief. Therefore, the present petition has been filed seeking an expeditious trial. 2/4

Having heard the learned counsel appearing for the petitioner and upon perusal of the materials available on record, this Court directs the learned Judicial Magistrate, Fast Track Court (NI Act), Puducherry, to strictly comply with the order dated 06.02.2024 passed by this Court in Crl.O.P.No.2403 of 2024 and by following the mandate of Section 143(3) of the Negotiable Instruments Act, to complete the trial in S.T.C.No.2542 of 2020 as expeditiously as possible, preferably, within a period of three months from the date of receipt of a copy of this order. 4.

Accordingly, this Criminal Original Petition stands disposed of.
