J U D G M E N T
The appeal preferred by the complainant against the order of acquittal by the Lower Court in a private complaint initiated under Section 138 of Negotiable Instruments Act, 1881.
2. The accused herein succeeded in his defence before the Appellate Court and the subject cheque was stolen from his lawfully possession and being misused.
3. The Learned Counsel for the appellant submit that the complainant passed away and his legal heirs are not inclined to pursue the matter further. In the said circumstances, this Criminal Appeal is dismissed as abated.
