2/6 PRAYER Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the Respondents 1 to 3 to survey the land of the petitioner in S. No.362A /1A2 to the extent of 4360 Square feets situated at Gudalur Village, Sholingur Taluk, Ranipet District forthwith. For Respondent:
ORDER
This writ petition has been filed for issue of writ of mandamus directing the 1 st and 2 nd respondent to act upon the application submitted by the petitioner on 14.09.2024 seeking for survey of the subject property. 2.Heard Mr.S.Sasikumar, learned counsel appearing on behalf of the petitioner, Mr.S.Jayachandran, learned Government Advocate appearing on behalf of respondents 1 to 3 and Mr.V.J.Priyadarsana, learned Government Advocate appearing on behalf of the 4 th respondent.
3.The petitioner is claiming right and title over the subject property by virtue of a registered Sale Deed dated 03.09.2014. The petitioner wanted a survey to be conducted in the property to demarcate the boundaries and hence,
3/6 he submitted an application on 14.09.2014. Whenever the survey was sought to be conducted, the same was disrupted by the 5 th respondent and as a result, a police complaint was given and it was taken on file in CSR No.323 of 2024. It is under these circumstances, the present writ petition has been filed before this Court.
4.Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the 1 st and 2 nd respondents to act upon the application submitted by the petitioner on 14.09.2024, if there are no civil proceedings pending or any restraint order has been passed in this regard by the competent Court and the survey shall be conducted in the subject property strictly based on the title documents and demarcate the boundaries. Such survey shall be conducted in the presence of the th respondent and the process shall be completed, within a period of four weeks from the date of receipt of copy of this order. If any law and order problem is sought to be created, the 4 th respondent shall give necessary police protection.
