The Writ Petition has been filed to direct the second respondent to consider the representation made by the first respondent on 30.12.2021 to hand over the petitioner's brother Ronald Doyle.

It is the case of the petitioner that her brother Ronald Doyle aged about 59 years had exhibited a little disturbance and unrest, therefore, her brother has been on psychiatric medication for the past 25 years and diagnosed with Schizophrenia. The petitioner have moved him to rehabilitation centre i.e. Revamp Hospital on 04.12.2021 to 27.12.2021 and to Helping Hearts Rehab on 27.12.2021 to continue his treatment. It is the further case that without her knowledge, the petitioner's brother has been shifted from the rehab and whereabouts of her brother is not known.

Learned Additional Public Prosecutor would submit that on 18.12.2021, one Heather Doyle, aged about 81 years, mother of the Ronald Doyle aged about 59 years had given a complaint stating that her son was taken by her daughter Judeline Tonita Doyle, the petitioner herein and her son-in-law, one Calvin Fernandez and she had been asking them to know his whereabouts for more than two months and that they have not given any information. She had also stated that the petitioner and petitioner's husband had not allowed her to speak to her son. Based on the complaint given by Heather Doyle, mother of Ronald Doyle, enquiry was conducted in C.S.R.No.1150 of 2021 and during enquiry, it was found that her son, Ronald Doyle was admitted in rehabilitation centre by the petitioner without her knowledge and after enquiry, the custody of Ronald Doyle was handed over to her. He would further submit that the detenue of Ronald Doyle is now in the custody of his mother Heather Doyle.
