Crl.O.P.No.46 of 2017 filed under Section 482 of the Criminal Procedure Code, to direct the respondents to withdraw the lookout circular issued by the second respondent against the petitioner in Crime No.674 of 2016* on the file of the first respondent police.

COMMON ORDER These Criminal Original Petitions have been filed to quash the lookout circulars issued by the second respondent, relating to Crime Nos.674 of 2016* and 818 of 2015 pending on the file of the first respondent police. Even though the prayer in both these Criminal Original Petitions refers to the same crime number, ie., Crime No.674 of 2016*, at the time of arguments, it was represented that Crl.O.P.No.27836 of 2016 has been filed in respect of quashing the lookout circular issued by the second respondent, relating to Crime No.818 of 2015. 2.The learned counsel for the petitioners has submitted that the petitioners have not been served with any summons relating to the crime numbers in question and hence the lookout circulars issued in that regard, have to be quashed. 3.

The first and second respondents appeared before this Court in person. Upon enquiry by the learned Additional Public Prosecutor in the Court, they submitted that no summons has been issued in respect of the lookout circular issued relating to Crime No.674 of 2016.* In view of the same, this Court is inclined to pass orders to withdraw the lookout circular issued in respect of Crime No.674 of 2016* on the file of the first respondent. Accordingly, the third respondent is directed to withdraw the lookout circular issued against the petitioners in respect of Crime No.674 of 2016.* Crl.O.P.No.46 of 2017 is disposed of accordingly.

4.In respect of Crime No.818 of 2015, the learned Additional Public Prosecutor submitted that no such lookout circular has been issued. Recording the said statement, the Crl.O.P.No.27836 of 2016 is closed.

5.However, it is needless to state that if there are any other proceedings pending against the petitioners, it is open to the respondents to proceed in accordance with law.
