The petitioner seeks anticipatory bail in Crime No.77 of 2023 registered by the respondent Police for the offences punishable under Sections 408, 465, 468, 471 & 420 of IPC.

2. It is the case of the prosecution that the petitioner was working as Accessorizes Executive Exchange in Sangeetha Mobiles Private Limited for several years.

3. It is stated that he replaced the device accessories from the customers and sold them to other branches and thereby unlawfully gained a sum of Rs.54,42,596/-.

4. The learned counsel for the petitioner stated that the petitioner is not responsible for the same and stated that it is the defacto complainant who has to be examined about all the issues. It is stated that it is not possible to take any accessories from the place, since there are CCTV cameras fixed. The learned counsel stated that the entire allegation is false. 1/3

A counter affidavit had been filed wherein, the respondent had enquired three separate witnesses who are working at Vadapalani Branch, MMDA Branch and Madurai Anna Nagar Branch who informed that they had received accessories from the petitioner and had transferred money through G-Pay to his HDFC account. There are issues which can never be denied or disputed particularly the flow of the money to the HDFC Bank of the petitioner.

6. In view of these facts, since further investigation will have to be done, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed. 29.02.2024 rjr 2/3
